Bringing criminal injury compensation claims within European Union

I was attacked on holiday in Tenerife last year leaving me with a large scar over my right eye. I believe I was drugged and mugged. Can I claim compensation?

EU Criminal Injuries Compensation Schemes

If you were injured as a result of a crime of violence in an EU country you can apply directly to that country for compensation.

However from 1 January 2006, UK residents injured as a result of a crime of violence in another country of the European Union on or after 1 July 2005 can apply for compensation from that country with the help of the Criminal Injuries Compensation Authority (CICA) in Glasgow.

This is a new service established following European Directive 2004/80/EC of 29 April 2004 which is intended to make it easier for victims to get compensation if they were injured as a result of a crime of violence in an EU Member State other than the one where they normally live.

The newly established EU Compensation Assistance Team (EUCAT) based in Glasgow can help with the following:

  • Access to information about the system of compensation in the country where you were injured;
  • Provide the appropriate application form;
  • Provide guidance on any supporting documentation that you might have to supply;
  • Forward your completed application to the relevant authority in the EU country where you were injured; and
  • Provide advice on how to respond to requests for further information.

Our First Response team will be able to assist with your claim.
