Holiday differed from description: can I get a refund?

When you purchase a holiday from a travel agents and the hotel differs from the description they gave you can you have a refund on return from your holiday?

All holidays must accord with the description in the brochure. Whether you are entitled to a refund on return from your holiday depends upon the extent of the mis-description. If you were promised a beach side apartment and ended up on top of a mountain then you could expect a full refund. If however, you were promised sea views but received an inland facing apartment then you could only claim a partial refund, if at all.
