We often have questions from people who are reluctant to claim. Given that the other party has to be at fault in order to succeed in your claim (and in this case they are clearly in breach of the Health & Safety regs) why would you not wish to claim? If your friend borrowed £5000 off you and failed to repay it you would want to pursue a claim. If they have negligently caused you the same or more loss you should seek to recover it.
