Jaw broken playing rugby: can I claim compensation against my school?

by Conrad Murray last modified 08-05-2007 01:51

I have fractured my jaw playing rugby at school - I am 18 - can I make an injury claim against the school?

Much depends upon the circumstances. Ordinarily sports such as Rugby and Football involve a degree of consent to physical assault.

You would need to show that the cause of your injury was beyond the level of consent given. You would need to pursue a claim against the player causing the injury via the insurers of the player which would either be his or her school or possibly their own insurers.

Generally speaking you need to show that the other player has assaulted you intentionally. For example if your injury was an accident as a result of a normal rugby tackle you would be unlikely to succeed but if your injury was caused by an unprovoked punch or deliberate foul and the other player was sent off then you could have a good claim.
